% 25.10.2017 CM No.26441/2016 (exemption) Exemption is allowed subject to all just exceptions. LPA 415/2016 & CM No.26440/2016 (stay) We are of the opinion that the order of the learned Single Judge does not call for interference.
The learned counsel first, however, pointed out that an application under the Right to Information Act (RTI) was declined; the CIC had cited - as one of the reasons, the rejection of the WP(C) No.4724/2016.
The denial of The RTI application is the subject matter of WP(C) 2932/2017.
LPA 415/2016
It is further clarified that while deciding WP(C) 2932/2017, the reasoning of the CIC that WP(C) No.4724/2016 was rejected, shall not be conclusive on the merits and the grievance under the RTI shall be considered. All rights and contentions of the parties in this regard are kept open.
The appeal is disposed of.
