W.P.(CRL) 2037/2018 Issue Notice. Mr. Chaitanya Gosain accepts notice on behalf of Mr. Rahul Mehra, standing counsel for GNCTD. Respondent No.3 is present in Court and accepts notice.

The petitioner has preferred the present writ petition to seek a writ of habeas corpus for production of his wife-Tarannum, who he claims to have married on 07.11.2016. The claim of the petitioner is that respondent No.3father of Tarannum took her away from the matrimonial home and since

then she has not been returned to join the petitioner. The status report is tendered in Court and is taken on record.

Tarannum is also present in Court. We have interacted with her in Court. She states that she married the petitioner and would like to reside with him. We have also interacted with respondent No.3 on the aspect that Tarannum being a major, is entitled to take her own decision in this regard. He is agreeable to the same.

Accordingly, we direct the SHO, PS Gokul Puri to ensure the safe passage of the petitioner and Tarannum from the Court itself to their residence. Tarannum may collect her personal belongings from her parental home. The SHO, PS Gokul Puri shall ensure that the said process is completed without any untoward event. The SHO, PS Gokul Puri shall promptly attend to any complaint from the petitioner or Tarannum in relation to any threat or coercion being exercised by respondent No.3 or his family members.
