% 12.07.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is also present in Court and accepts notice. She has been identified by SI Sumit of police station Aman Vihar.

Respondent no. 2 submits that she has settled all her disputes with the petitioner before the Delhi Mediation Centre, Rohini Court, Delhi on 3rd February, 2018. Her marriage with petitioner has already been dissolved by a decree of divorce by mutual consent on 28th May, 2018 passed by the Family Courts, Rohini Court, Delhi.

Petitioner has paid `2 lacs to the respondent no. 2 vide a cheque, photocopy whereof has been placed on record. Respondent no. 2 submits that with this payment entire settled amount of `10 lacs stands paid and she has no objection in case FIR No.

374/2015 under Sections 498A/406/34 IPC registered at police station Aman Vihar is quashed, subject to encashment of the aforesaid cheque. Keeping in mind the settlement arrived at between the parties and that marriage between the petitioner and respondent no. 2 has already been dissolved, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
