1. Learned counsel for the Petitioner seeks leave to withdraw this petition with liberty to approach the Commissioner (Appeals) against the impugned order dated 28th June 2016 passed by the Joint Commissioner.
2. If such an appeal is filed within three days from today, as has been assured by Mr. Priyadarshi Manish, learned counsel for the Petitioner, then the Commissioner (Appeals) will endeavour to dispose of such appeal, after giving an opportunity of being heard to the Petitioner, within a period of ten days thereafter.
