Mr. Harish Malhotra, learned Senior Counsel appearing on behalf of Defendant No. 1 submits that during the pendency of the suit, Defendant No. 1 has expired on 10.02.2025 but no steps have been by the Plaintiff to bring on record his legal heirs and thus, the suit stands abated. He further submits that on 16.07.2024, counsel for Defendant No. 2 has already stated before the Court that the said Defendant does not wish to contest the suit. 2.

Matter has been called twice but there is no appearance on behalf of the Plaintiff. The suit is accordingly dismissed for non-prosecution and in default.
