% 23.04.2018 After some arguments, Mr. Shiv Charan Garg, learned counsel appearing on behalf of the appellant, on instructions, seeks leave to withdraw this appeal.
Leave granted.
The appeal is dismissed as withdrawn and disposed of accordingly. Pending application also stands disposed of. However, a perusal of the impugned order dated 08.10.2016 reveals that the same does not state any reasons in relation to the finding that the appellant wife is primarily responsible for the delay in the disposal of the petition of dissolution of marriage filed on behalf of the respondent husband.
Insofar as that finding is concerned, as well as, the conclusion that the appellant's conduct does not seem bona fide, the same not
being germane or relevant, for the purposes of the determination of the application for enhancement of maintenance pendent lite, filed by the appellant wife under Section 24 of the Hindu Marriage Act, 1955, are accordingly set aside.
