% 01.08.2018 The first respondent was arrested during investigation of FIR No. 247/2016 under Section 376 IPC on 26.04.2016. By order dated 29.04.2016, he was enlarged on bail pending investigation by the court of Sessions. The petition at hand was filed taking exception to the said order with the prayer that it be set aside primarily on the ground that the Sessions court had failed to appreciate the gravity of the offence involved. Having heard and having perused the record, this Court finds no good reason to interfere.
The allegations by the prosecutrix (petitioner herein) essentially are that the second respondent had engaged her in a sexual intercourse on the promise of marriage, he having backed out later. The public prosecutor points out that the case has made progress as after the charge-sheet has been filed, cognizance was taken, the second respondent summoned and charges CRL.M.C. 2463/2016
having been framed.
The statement of the petitioner has already been recorded. In these background facts, no case is made out for cancellation or withdrawal of the bail order.
The petition is dismissed.
