% 02.09.2016 C.M. No.31441/2016 (exemption) Exemption is allowed subject to just exceptions. Application disposed of.

W.P.(C) 7626/2016 & C.M. No.31442/2016 There are three petitioners before this Court. They are stated to be vending from M-Block Market, Greater Kailash Part-I, New Delhi. They have filed certain challans in support of their stands. Additional submission of the learned counsel for the petitioners is that they are adequately protected under Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

Learned counsel for the respondent no.1 submits that these

challans are merely prosecution challans and they do not create any right in favour of the aforenoted petitioners. Be that as it may, noting the aforenoted submissions in view of the promulgation of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and in view of the judgment of the Division Bench in LPA No.136/2016 Bhola Ram Patel Vs. NDMC & Others this writ petition is disposed of giving liberty to the petitioners to get their grievances addressed before the Town Vending Committee (TVC) of the respondent/SDMC as and when it is constituted as it has been informed to this Court that TVC of SDMC is yet in the process of being constituted. No further orders are called for on this petition. Petition disposed of.

Petition is disposed of.
