O R D E R

% 29.07.2016 The applicant seeks anticipatory bail under Section 438 Cr.P.C. apprehending arrest in case FIR No.208/2016 under Section 420/ 34 IPC registered at Police Station - North Rohini.

The submission of learned counsel for the applicant is that on the reading of the FIR, it is not made out that the complainant had seen the car herself. According to the complainant, the applicant and the other accused were on foot when they allegedly took her gold bangles and put a bundle in her bag. The complainant has stated that she was informed of the car number by some other person. Learned counsel submits that the colour of

the car disclosed in the FIR is grey colour, whereas the colour of the car of the applicant is blue. He further submits that the applicant is willing to join the investigation as and when called for.

Learned APP points out that there are other involvements of the applicant. He is involved in another case under Section 394/ 411/ 34 IPC in FIR No.54/2012 registered at Police Station North Rohini on 11.02.2012. The same is pending investigation. She further submits that the applicant is required for his identification by the complainant. Learned counsel for the applicant has submitted that he shall join the investigation and shall also join the TIP.

In these circumstances, it is directed that in case of his arrest, the applicant shall be released on bail upon his furnishing a personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the arresting officer. The same is subject to the condition that the applicant shall join the investigation as and when called for and shall also join the TIP proceedings. The bail application stands disposed of.
