% 15.07.2016 The petitioner has filed the present petition seeking a direction to the respondent to grant admission to the petitioner in Class XI in the academic year 2016-17 in any of the schools near his residence. The petitioner claims to be residing in M-2/24, Model Town-III, New Delhi-110009.

Learned counsel for the respondent submits that the petitioner had approached the Government Boys Senior Secondary School No.1, Model Town-III for seeking admission in Class XI (Commerce without Maths). She contends that the said admission could not be granted because the petitioner did not have the requisite marks, as stipulated by the Circular dated 31.05.2016 of the Government of NCT of Delhi. Learned counsel for the petitioner contends that the petitioner is seeking admission in any stream which the petitioner WP(C) 5912/2016

may be eligible for in accordance with his marks. Learned counsel for the petitioner further contends that the sister of the petitioner is studying in a girl's school adjoining the Government Boys Senior Secondary School No.1, Model Town-III in which the petitioner has sought admission.

He contends that she has been granted admission on the basis of the same residential address. Learned counsel for the respondent further contends that the petitioner has not furnished the address proof of the residence of the petitioner.

The petitioner is directed to furnish the address proof to the respondent within two days. On furnishing of the requisite address proof, the respondent shall consider the application of the petitioner and grant admission to the petitioner in the eligible stream in an appropriate school in accordance with the Rules within one week.
