% 11.07.2018 By this petition, petitioner which is an NGO seeks transfer of investigation in case FIR No.208/2018 registered under Sections 376/377/354/34 IPC at PS Fatehpur Beri to CBI. The petitioner is neither a victim nor an accused in the FIR. The present petition has not been treated as public interest litigation.

Faced with this situation, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to the victims to file a fresh petition for the same.

Leave and liberty granted.
