The counsel for the petitioner in both petitions and the counsel for the respondent (in both petitions) state that the matter has been settled in Mediation. They further state that the settlement with respect to RC. Rev. No.337/2016 has already been implemented and thus the counsel for the petitioner Devender Kumar Jain withdraws RC. Rev. No.337/2016 2.

RC. Rev. No.337/2016 is dismissed as withdrawn. 3.

The counsels state that the settlement arrived at with respect to RC. Rev. No.338/2016 is to be implemented by 23rd January, 2018 when the petitioner Virender Kumar Jain has agreed to deliver possession to the respondent of the premises, with respect to order of eviction wherefrom this RC.REV. 337/2016 and RC.REV. 338/2016

petition was filed. It is further stated that as per the settlement, the respondent has also to pay mutually agreed amounts at the time of the petitioner Virender Kumar Jain handing over possession. 4.

The Settlement Agreement dated 24th July, 2017 received from the Mediation Cell of this Court and bearing the signatures of the petitioner in both the petitions and the respondent and their Advocates and the Mediator Jasbir Kaur, Advocate is on record of RC. Rev. No.337/2016. 5.

The petitioner Virender Kumar Jain and respondent Jeet Singh Sandhu are ordered to be bound by the settlement as contained in the said Settlement Agreement and cautioning both of them that breach of the said settlement would have the effect of breach of undertaking given to this Court, RC. Rev. No.338/2016 is also disposed of. No costs.
