The petitioner seeks quashing of FIR No.178/2010 under Sections 279/304A/465/468/471/474/120B/34 IPC, Police Station Najafgarh, based on a settlement.

It is noticed that an earlier petition seeking quashing of the said FIR, based on a settlement, being Crl.M.C.2986/2016 was dismissed by this Court by order dated 22.08.2016 holding that, in the facts of the present case, the proceedings could not be quashed on a settlement.

Learned counsel for the petitioner submits that he shall be assailing the said order whereby the earlier petition was dismissed CRL.M.C. 3974/2018

and, in view thereof, he seeks leave to withdraw the petition. 4.
