CRL.M.C. 2470/2016 By the present petition the petitioners Abdul Rehman, Faizan and Mrs. Mehtab Begum seek quashing of FIR No.284/2015 under Sections 342/380/34 IPC registered at PS Sadar Bazar on the ground that they have settled the matter with respondent No.2 Mrs. Rehana Begum, the complainant in the above-mentioned FIR.
Issue notice.
Learned APP accepts notice on behalf of the State. Learned APP on instructions from the Investigating Officer points out that besides the petitioners there are two other accused persons mentioned in CRL.M.C. 2470/2016
the FIR, that is, Rahisa Khatoon and Bilqees. Learned counsel for the petitioners informs that Mrs. Rahisa Khatoon has since passed away and Mrs. Bilqees is not a party to the settlement. Since all the parties to the FIR have not been impleaded this Court is not inclined to quash this petition at this stage. Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file fresh petition impleading all the surviving accused as parties for quashing of FIR.
Leave and liberty granted.
Petition is dismissed as withdrawn.
