% 25.09.2018 Learned counsel for petitioner submits that petitioner is neither Director nor was he employed with M/s Shri Bihariji Buildmart Pvt. Ltd. He had not signed any agreement for or on behalf of M/s Shri Bihariji Buildmart Pvt. Ltd. with the complainant. Petitioner had not issued any receipt for or on behalf of M/s Shri Bihariji Buildmart Pvt. Ltd..

He had only signed one Memorandum of Understanding between M/s Shri Bihariji Buildmart Pvt. Ltd. and M/s. U S Estate through its proprietor Mr. Virender Mehra as a witness. Learned APP for the State submits that petitioner had received money, however, learned APP has failed to point out any receipt issued by the petitioner.

Petitioner has already joined the investigation. Keeping in mind the totality of facts and circumstances, it is ordered that in case

of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `50,000/-(Rupees Fifty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. However, petitioner shall co-operate in the investigation and shall appear before the Investigating Officer as and when he is called upon to do so. Bail application is disposed of in the above terms.
