O R D E R
% 06.01.2017 The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.272/2014 under Section 395/ 397/ 34 IPC registered at PS - Maurya Enclave. The petitioner is one of the co-accused. He is in judicial custody since 19.05.2014.
The submission of learned counsel for the petitioner is that the complainant/ PW-2 has not identified the petitioner as one of the persons, who have committed the offence. He further submits that one of the other co-accused Harpreet Singh @ Hunny @ London has been granted bail by
this Court on 29.09.2016 for the same reason. The petitioner seeks parity. Mr. Mukesh Kumar, on instructions, does not dispute the fact that the petitioner has not been identified by the complainant as the person who has robbed the complainant of the jewellery in question. In view of the aforesaid, the application is allowed. The petitioner is directed to be released on bail subject to:
i) his furnishing personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the Trial Court; ii) he shall provide his mobile phone number to the Trial Court at the time of his release, which shall be kept in working condition at all times and shall not be changed without prior intimation to the Court; iii) he shall not leave Delhi without prior intimation to the I.O. concerned;
iv) he shall not get in touch with any of the prosecution witnesses or tamper with the evidence in the case; and v) he shall not be released in the present case unless he obtains bail in other case(s) in which he is involved.
