O R D E R

% 05.09.2016 The status report has been filed by the State. The facts narrated by the petitioner had been got verified. The mother of the petitioner had passed away on 01.09.2016. The wife of the petitioner is also suffering from an eye problem. The petitioner is seeking parole to be able to perform the ceremonies relating to the death of his mother, and to attend to his ailing wife.

The submission of learned counsel for the State is that the petitioner was subjected to punishment on 14.10.2015.

Learned counsel for the petitioner states that the said punishment was inflicted upon the petitioner as he was found in possession of a non-working SIM on the date immediately after his surrender. The fact that the SIM was not working has also been got verified by the State. In view of the aforesaid circumstances, I am inclined to grant parole to the petitioner. The petitioner is undergoing sentence of 5 years Rigorous Imprisonment under Section 306 IPC. Out of the said period, he has already undergone about 3 years and 2 months incarceration. He has also earned remission of 4 months and 24 days. His conduct, apart from the aforesaid incident regarding the punishment on 14.10.2015, has been found to be satisfactory.

Accordingly, the petition is allowed. The petitioner is directed to be released on parole for a period of four weeks subject to his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent. The petitioner shall surrender on the expiry of the said period. He shall mark his attendance on every Monday at 11 a.m. at the local police station concerned during the period of his parole. The petition stands disposed of.
