% 03.10.2016 Attention of learned counsel for the petitioner has been drawn to a judgment of the Supreme Court in Kanwar Singh Saini. Vs. High Court of Delhi, (2012) 4 SCC 307 and a judgment of this Court in Jamna Datwani Vs. Kishin Datwani & Ors., Cont. Cas (C) 652/2014, decided on 24th September, 2014.

In view thereof, learned counsel for the petitioner wishes to withdraw the present contempt petition and applications with liberty to file execution proceedings.

With the aforesaid liberty, the present contempt petition and application are dismissed as withdrawn. Rights and contentions of all parties are left open.
