% 30.09.2016 After some arguments learned counsel for the petitioner seeks liberty to withdraw the present petition with liberty to file a petition under section 24 of the Code of Civil Procedure so that the two suits in question can be heard by the same court.

Granting the leave and liberty as prayed for, petition is dismissed as withdrawn. All pending applications also stand disposed of accordingly.
