% 31.05.2018 CM APPL. 23993/2018 & RFA 152/2017 This is an application praying for setting aside the order dated 13th February, 2018. A perusal of the order sheet shows that the Appellant did not appear on five dates and also failed to take any steps to implead the LRs. No reason has been given for non-appearance and for non-taking steps. Moreover, learned counsel for the Appellant, on the one hand, submits that this is a family matter and this may be settled and on the other hand, expresses ignorance as to the LRs of Respondent No.1. Since the matter is between family members, the LRs of Respondent No.1 are well within the knowledge of the Appellant, so there is no justification for not having taken steps taken for impleading the LRs and for the repeated nonappearance. Under these circumstances, no ground is made out for restoring the appeal. The same is dismissed.
