% 03.02.2016 IA 1605/2016 This application has been filed by the plaintiff under Order 23 Rule 1 read with Section 151 CPC, seeking permission to withdraw the present suit in terms of the settlement agreement dated November 24, 2015. Even though, one of the prayer made is to the decree the suit in terms of the settlement agreement dated November 24, 2015, learned counsel for the plaintiff states, in view of the settlement, he would like to withdraw the present suit. Accordingly, the suit is dismissed as withdrawn. As the parties have entered into a settlement out of Court before any evidence has been recorded on the merits of the claim, the plaintiff is entitled to refund of Court Fees in terms of Section 16A of the Court Fees Act, 1870.
