O.M.P.(I) (COMM.) 283/2016 Issue notice.

Mr Debasish Moitra, learned counsel accepts notice and further submits that he would have no objection, if all the issues raised in the present petition are considered by the Arbitral Tribunal as and when constituted.

He further submits that premises in question namely A-113, Mayapuri Industrial Area, Phase - 2, New Delhi - 110064 has already been let out.

Be that as it may.

It is directed that respondent shall maintain the status quo as to the possession of the property and also is restrained from creating any further third party interest qua the same.

Learned counsel for the Petitioner states that petitioner shall file an application under Section 17 of the Arbitration and Conciliation Act, 1996 immediately on the Arbitral Tribunal being constituted. The aforesaid restrain order is subject to any orders that may be passed by the Arbitral Tribunal and shall continue till the time such application is decided by the Arbitral Tribunal.
