% 26.10.2016

1. This petition has been pending since July, 2016 and no interim orders have been passed till now. In the meanwhile, the arbitration proceedings have carried on and the arguments have concluded. The Award has been reserved.

2. It may be noticed here that two of the reliefs require the Respondents to deposit the amount in the Court pending the arbitration proceedings and the third is to restrain the Respondents from selling the spectrum.

3. The Court's attention has been drawn to an order dated 14th September, 2016 passed in some other matter involving the Respondent herein where inter alia it has been noted that the spectrum has already been sold. O.M.P.(I) (COMM.)289/2016

Therefore, the third prayer cannot be entertained insofar as the present petition is concerned. As far as the first two prayers are concerned, considering that the arbitration has almost concluded and only the Award is to be rendered, the Court is not inclined to grant the said interim relief at this stage.

4. The petition is disposed of.
