O R D E R

% 11.02.2016 In view of notification no 27187/DHC/Orgl. Dated 24.11.2015 & in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), which came into force with effect from 26.10.2015 vide Notification No. F. No. L-19015/04/2012-Jus dated 26.10.2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs, published in Gazette of India Extraordinary, Part-II, Section 3 Sub Section (ii), the present matter stands transferred to the jurisdictional subordinate courts.

Plaintiff has not taken the steps for the service of the defendants 1 & 2 despite repeated direction given by the Court as such, plaintiff will be burdened with cost of Rs 10,000/- to be deposited in Prime Minister's Relief Fund within four weeks time. Plaintiff be directed to comply with the order dated 21.09.2015 in toto.

Steps be taken within two weeks time.

Learned counsel for the plaintiff submits that the valuation of the suit property for the purpose of pecuniary jurisdiction is less than two crores and suit property falls within the jurisdiction of Central District as such requests to send the matter to the Ld District & Session Judge (Central District), Tis Hazari Court. Hence, in view of the submission and circumstances, the matter be sent to the Ld District & Session Judge, (Central District) Tis Hazari Court.

Plaintiff be directed to get intimated to the opposite party/defendant's counsel regarding the transferring of the case to the Ld District & Session Judge (Central District), Tis Hazari Court and the date fixed through postal authority within a week time under the intimation to this Court.

Parties be directed to appear before the Court of Ld District & Session Judge (Central District), Tis Hazari Court on 14.07.2016. The suit files be made available to the Ld District & Session Judge (Central District) at Tis Hazari Court on the date fixed. DR.
