After arguments, this appeal is disposed of with the consent order by reducing the rate of interest granted by the trial court in the impugned judgment from 12% per annum to 9% per annum simple. Rest of the decree will stand and is sustained. 2.

Appellant will pay the amount in terms of the impugned judgment as modified for the rate of interest stated today on or before 27.11.2018 and in case the amount is not paid to the respondents/plaintiffs on or before 27.11.2018 then the rate of interest will remain the same at 12% per annum simple. 3.

As stated by counsel for the respondents the amount to be paid by the appellant in terms of the impugned judgment, and as modified RFA 708/2018

by today's order, will be deposited in the account No. 0205-00561144-190001 in the name of 'G-39 Co-owners' maintained with Catholic Syrian Bank, Connaught Place Branch, New Delhi. 4.

The appeal is disposed of in terms of the aforesaid consent order.
