% 13.07.2016 Present FIR No.337/2016 under section 323/341/379/34 IPC was registered at police station Model Town on the complaint of respondent no.2, who has alleged in the FIR that he was beaten by petitioners on 31st May, 2016 at about 12:20 am near Nanak Piao Gurudwara, G. T. Karnal Road, Delhi, as a result thereof he sustained injuries on his nose and head. Rs.25,000/- were snatched by petitioner no.2 and someone also broke his chain from behind.
Petitioners and respondent no.2 are known to each other, inasmuch as, they are residing in the same locality. It is submitted that petitioners and respondent no.2 have now settled their disputes amicably in order to maintain harmonious relations in future as they belong to same community, inasmuch as, are living in the same colony. Petitioners have
paid Rs.25,000/- to respondent no.2, receipt whereof has been admitted by the respondent no.2, who is present in Court and has been identified by the Investigating Officer SI Jagender Kumar of PS Model Town. Respondent no.2 submits that he does not wish to pursue the FIR any further. Petitioners have no previous criminal record.
Keeping in mind the above facts and in the interest of justice, the FIR No.337/2016 under section 323/341/379/34 IPC registered at police station Model Town and the consequent proceedings emanating therefrom are quashed.
Writ petition is disposed of in the above terms. Dasti.
