% 18.07.2018 By this petition, the petitioner seeks anticipatory bail in case FIR No. 388/2015 under Sections 376/366/328/323 IPC registered at PS Bhalswa Dairy.

The above noted FIR was registered on the complaint alleging that on 20th June, 2015 at about 7.30 PM while she was coming from Bhajan Pura after attending Dance Class, the petitioner who is a resident of Mukund Pur, made her smell something whereafter she lost her consciousness. When she gained consciousness she was in a room along with the petitioner. The petitioner threatened her and stated that he was taking revenge for the quarrel 4-5 months ago. The petitioner forcibly made physical relation with her, beat her and kept her in a room.

The earlier anticipatory bail application filed by the petitioner was BAIL APPLN. 1605/2018

dismissed as withdrawn on 8th August, 2016. Merely because now the petitioner has married the complainant cannot be a ground for granting anticipatory bail in the serious offence alleged. Petition is dismissed.
