The petitioner‟s grievance is that his registered vehicle (Mahindra Scorpio DL 1N 8774) was seized by the police, since 20 cases of liquor were found inside it. Subsequently, First Information Report (FIR) No.19/2017 was registered at Police Station Naraina. The seizure was effected on 23.01.2017. Petitioner states that despite request made to the Deputy Commissioner, (Excise) Delhi on 15.03.2017, no action has been taken till date.
Learned counsel for the respondent submitted that for the seizure made, the Commissioner is yet to pass orders indicating the necessary conditions, awaiting report of the Investigating Officer. The fact shows that the seizure was made more than one and half year back. The Deputy Commissioner has not yet made any order in this regard. Given these circumstances, the petitioner‟s request is reasonable. Accordingly, the Deputy Commissioner is directed to order release of the vehicle to its lawful owner, after indicating such conditions as are lawful, within three days, in accordance with law. With aforesaid directions, the writ petition filed by the petitioner is allowed and disposed of accordingly. A copy of this order be given dasti.
