O R D E R

% 08.11.2016 The petitioner has preferred the present petition to seek the quashing of order dated 23.05.2016 whereby the application to seek parole has been rejected and also seeks a direction that he be released on parole for a period of three months. The nominal roll shows that the petitioner stands convicted under Section 302/307/34 IPC in case FIR 279/2006 and has been sentenced to rigorous imprisonment for life with fine. His appeal has been dismissed by this court on 17.11.2014. The petitioner has undergone 9 years 3 months and 15 days incarceration as on 05.06.2016. His jail conduct is satisfactory. Earlier, he was released on parole between 13.08.2015 and 14.09.2015 by this court and it is not reported that his conduct was not satisfactory and he

did not surrender on time.

Mr. Singh has tendered in court the status report. The address furnished by the petitioner has been got verified. The petitioner is seeking parole on account of the fact that his son has cleared the 12th board examination and he needs to arrange funds for the same.

In these circumstances, the petitioner is directed to be released on parole for a period of four weeks subject to: i) his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; v) he shall not contact the victim's family who stays in the same vicinity and shall not enter into altercation with them; vi) he shall also not indulge in any criminal activity while on parole. The SHO PS Adarsh Nagar is directed to keep a vigil so as to prevent any untoward incident.

Petition stands disposed of.
