% 26.07.2016 Crl.M.A. 11197/2016 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 1483/2016 The present application under Section 439 Cr.P.C. has been filed for the grant of regular bail in FIR No.0024/2016, under Section 20/25/29 of the NDPS Act, Police Station Crime Branch. As per FIR, the allegations levelled against the accused are that he was caught while in possession of 150 kg ganja. Admittedly, the bail has been refused by the Court below as there is embargo of Section 37 of the NDPS Act. The counsel for the petitioner has not
disputed the embargo of Section 37 of the NDPS Act imposed by the statute.
In view of embargo of Section 37 of the NDPS Act, no ground is made out to grant the bail to the petitioner. The application is accordingly dismissed.
