% 22.08.2016 Respondent No.2, Priyanka Arora has appeared in person along with child Divij, aged about 18 months. Priyanka Arora has expressed her inability, at this stage, to go for mediation. She states that she had participated in mediation proceedings but things could not be sorted out. She, however, agreed that Divij can interact and be with his grandparents and the petitioner-Pankaj Khanna till 5.15 p.m. in the Court room itself.
During the course of hearing, the parties, who are present in person, have agreed that Pankaj Khanna can visit the residence of
Chander Mohan Arora, father of Priyanka Arora, at B-12, Ram Bagh, Rampur Road, Haldwani on a weekend once a month and can interact with the child Divij for three hours. Priyanka Arora states that subsequently and subject to her agreeing, Neelam Khanna, grandmother, could also visit Haldwani with Pankaj Khanna. Pankaj Khanna will get in touch with Chander Mohan Arora on telephone to fix the date and time as per mutual convenience, for visiting and meeting Divij.
In view of and recording the aforesaid statements, the writ petition is disposed of. We clarify that this Court has not examined the question of guardianship of the child.
Rs.25,000/- deposited by the petitioner in the Court would be paid to Priyanka Arora.
