% 10.02.2017 We are informed that the sole arbitrator has already been appointed and he is proceeding with the arbitration.

After hearing the learned counsel for the parties, we are not inclined to interfere with the impugned order.

However, it is open to either party to seek modification of the impugned order which has been passed under Section 9 of the Arbitration and Conciliation Act, 1996. If and when such an application is made before the learned Arbitrator, it would be open to him to pass any order, including modification of the orders already passed, if necessary, in accordance with law. The appeal stands disposed of, as above.

The interim order that we have passed in the present appeal shall continue for a period of 10 days. If any application is made, it will be open to the learned

Arbitrator to modify the same, if necessary. This order shall not be construed as an order in favour of the appellant.
