The instant petition under Sections 433 (e) and 434 read with Section 439 of the Companies Act, 1956 read with Rules 6 and 9 of the Companies (Court) Rules, 1959 has been filed on behalf of the petitioner seeking the following reliefs:

"a) pass an order of winding up of the Respondent Company MVL Ltd. Registered office at 1201-B, Hemkunt Chamber, 89 Nehru Place, New Delhi-19, under the provisions of the Companies Act, 1956 and also at MVL iPark, 6th Floor, Near Red Cross Society, Chandan Nagar, Sector 15 (1), Gurgaon122001; (b) appoint an Official Liquidator to take possession of the assets/property and books of accounts of the Respondent Company lying at the Registered Office of the Respondent as well as Gurgaon office;

(c) direct the Respondent to give details/particulars of each and every bank account maintained by it, (d) direct the Respondent to give details/particulars of the investments/ deposits under the name of Respondent in banks, securities etc.;

(e) Cost of the petition be awarded to the Petitioner, and (f) pass such other or further order(s) as this Hon'ble Court may deem fit under the facts and circumstance of the case." 2.

Learned counsel appearing on behalf of the parties fairly conceded that all the issues pertaining to instant petition are similar to the issues which are pending in Item no. 39 listed today i.e. CO.PET. 668/2014, therefore, there is no requirement for further adjudication in the instant petition. 3.

It is further submitted that all the issues may be adjudicated and decided while adjudicating the company petition i.e. CO.PET. 668/2014 and the instant petition may be disposed of accordingly. 4.

Accordingly, the instant petition stands disposed of in light of the submissions advanced by learned counsel appearing on behalf of the respective parties as well as on behalf of the learned Standing Counsel appearing on behalf of the Official Liquidator. 5.

Pending applications, if any, also stand disposed of.
