% 10.08.2016 CM No. 29001/2016 (exemption) Exemption is allowed subject to all just exceptions. CM(M) 769/2016 The limited grievance of the petitioner in the present petition is that his application under Order 39 Rules 1 and 2 CPC on which arguments have been heard by the trial court and the written statement has also been filed has not been disposed of.
He relies upon the order dated 23.01.2016 by which the trial court noted that the case is fixed for orders on the application under Order 39 Rules 1 and 2 CPC but the orders could not be pronounced as defendant No.1/respondent No.1 has filed an application under Order 8 Rule 1A(3) CPC for filing additional documents. He submits that the said application is pending adjudication for the one reason or the other and the petitioner's CM(M) 769/2016
injunction application is languishing on account of the said tactics adopted by the respondents.
The petitioner is granted liberty to approach the trial court with an appropriate application to request expeditious disposal of the application of the petitioner under Order 39 Rules 1 and 2 CPC. In case such an application is filed, the trial court is requested to deal with the said application expeditiously preferably within two months from today.
