% 05.08.2016 The petitioner is aggrieved by the fact that the Tehsildar/respondent No.2 had not agreed to fill his form 5 in spite of the admitted position that the petitioner was in cultivatory possession of the land forming a part of Khasra No.45/14/1(1-02). Learned counsel for the respondent, who is appearing on advance notice submits that all actions of the Tehsildar are appealable before the Deputy Collector and the petitioner should take recourse before the Appellate Board.

Learned counsel for the petitioner at this stage seeks liberty to withdraw the petition with additional liberty to take appropriate course of law as per law and to file an appeal before the Appellate Board.

Dismissed as withdrawn with liberty granted to the petitioner to take appropriate remedy before the appropriate forum as per law with the time bound frame.
