W.P.(CRL) 2140/2016 Issue notice. Ms. Rao accepts notice on behalf of the State. On behalf of respondent No.2/ M/s Albatross Shipping Ltd., Mr.Dharmender Kumar appears. He states that he is authorised representative of respondent No.2. Mr. Dharmender Kumar is identified by the IO.

The present petition seeks quashing of the FIR No.231/2015 dated

17.03.2015 registered at Police Station - Okhla Industrial Estate under Section 406/ 420 IPC on the complaint of respondent No.2 against the petitioners. The parties have arrived at a settlement dated 13.04.2015 in mediation. Copy of the same has been placed on record. The petitioners seek quashing of the aforesaid FIR on the basis of the said settlement. Under the settlement, the petitioner has already made payment of Rs.21 Lakhs to the complainant/ respondent No.2.

Mr. Dharmender Kumar, the authorised representative of respondent No.2 states that respondent No.2 does not wish to pursue the said complaint any further and he also joins the prayer that the FIR in question be quashed in view of the settlement with the petitioners. In these circumstances, no useful purpose would be served in proceeding further with the FIR in question and the proceedings arising therefrom. The same are hereby quashed.
