% 18.07.2016 Crl.M.A. 10640/2016 Exemption allowed subject to just exceptions. CRL.M.C. 2477/2016 This is a petition for quashing of FIR No. 400/2013 under Sections 498A/406/34 IPC registered at PS Khyala, Delhi. The complainant/Respondent No. 2 is present in person who is identified by the Investigating Officer and her counsel. The complainant states that the disputes between the Petitioner No. 1 and her have been amicably resolved and they are living together as husband and wife. In view of the fact that the disputes between the parties have been resolved the complainant does not want to pursue the present complaint. CRL.M.C. 2477/2016

Learned counsel for the State on instructions from Investigating Officer states that besides the Petitioners there is no other accused involved in the FIR as Ms. Rukhsana has already been discharged and besides Respondent No. 2 there is no other complainant/victim. The petitioner No.1 who is present in Court and is identified by the counsel states that he would create no problem for the respondent No.2 and behave properly in future.

Since the parties have amicably resolved their difference and the pendency of the present proceedings will bring further acrimony and disharmony between the two, it would be in the interest of justice if the present FIR is quashed.

Accordingly, FIR No. 400/2013 under Sections 498A/406/34 IPC registered at PS Khyala, Delhi and the proceedings pursuant thereto are quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
