BAIL APPLN. 1624/2018 The learned counsel for the parties submit that efforts have been made to save the marriage of the young couple i.e. the complainant and the petitioner. In an endeavour to salvage the matrimonial ties, an accommodation, identified by the complainant, has been taken on rent by the petitioner, by way of a rent agreement dated 21.08.2018. A copy of the same has been handed over to the learned counsel for the respondents. Let the same be filed in Court. The keys to the said property shall be handed over to the complainant, through her counsel during the course of the day.

The petitioner shall ensure that it is cleaned up and all the belongings of the couple, especially all those items which the complainant identifies, are shifted from the house of her in-laws to the newly tenanted premises, so that she can set up her matrimonial home there. The petitioner will also arrange for the transportation of the furniture and all belongings of the complainant and provide work-force and other necessary assistance to her, in setting up the new residence, in the next four days.

The petitioner shall continue to pay the rent for the said premises till such time that the respondent desires to reside in the premises or an alternative accommodation, with equivalent amenities, case of access and residential status is provided to her, should the occasion for the same arise. He will continue to pay rent for the subsequent accommodation as well. The petitioner has expressed his desire to resume co-habitation with the complainant-his wife and endeavour to salvage his marriage. In view of the above, the interim protection granted to the petitioner is confirmed. In the event of arrest, he shall be released on his furnishing a bail bond of Rs. 25,000/- with two sureties of the like amount subject to the satisfaction of the Investigating Officer.

The petition is disposed off in the above terms. NAJMI WAZIRI, J.
