O R D E R

This Court does not have the pecuniary jurisdiction. All aspects, therefore, for revival of the suit on account of non compliance of the agreement entered into between the Delhi High Court Mediation and Conciliation Centre, will be looked into by the concerned jurisdictional Court.

An Office Order dated 24.11.2015 has been issued by Hon'ble the Chief Justice in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, whereby ordinary suits which are not commercial matters having pecuniary jurisdiction up to the value of rupees two crores cannot be tried by this Court and commercial matters up to the value of rupees one crore cannot be tried by this Court. Accordingly, this suit is transferred for decision to the jurisdictional Court under the District & Sessions Judge, Dwarka Courts, New Delhi.

Let parties appear before the District & Sessions Judge, Dwarka Courts, New Delhi, on 10th March, 2016. Suit file be made available to the District & Sessions Judge, Dwarka Courts, New Delhi on the date fixed. CCP (O) no.139/2011 4.

This contempt petition lies if there is a violation of undertaking to a court or violation of an order passed by this Court. Violation of the terms of the settlement entered into in the mediation resulting in a compromise decree, will not amount to an undertaking to a court or violation of an order of a court.

Contempt petition is accordingly dismissed.
