% 27.07.2016 Crl.M.A. 11276/2016 Exemption allowed, subject to all just exceptions. Crl.M.C. 2629/2016 By the present petition, the petitioner seeks quashing of FIR no. 553/2012 under Sections 308/34 IPC registered at PS Seema Puri on the complaint of respondent No.2 Sachin S/o Om Prakash Sharma. Learned APP for the State on instructions from investigating officer submits that besides the four petitioners there is no other accused in the FIR and besides the two respondents i.e. respondent Nos. 2 and 3 both namely Sachin Sharma S/o Om Prakash Sharma and Bhupender respectively there is no other victim.

Both respondent Nos. 2 and 3 are present in Court and are identified by the investigating officer. They state that they have settled the matter with

the petitioners and do not wish to pursue the abovementioned FIR and proceedings pursuant thereto.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR no. 553/2012 under Sections 308/34 IPC registered at PS Seema Puri, Delhi and proceedings pursuant thereto are hereby quashed, subject to each of the petitioner depositing a sum of `10,000/- with the Juvenile Justice Fund of Delhi High Court maintained by the Registrar General within two weeks.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of. Order dasti.
