BAIL APPLN. 1364/2016 Issue notice.

Learned APP accepts notice on behalf of the State. By this petition the petitioner seeks anticipatory bail in case FIR No. 260/2016 under Sections 354/34 IPC registered at PS Najafgarh, Delhi. Learned counsel for the petitioner points out that prior to registration of the above noted FIR, in the year 2010 the petitioner filed another FIR against the husband of the complainant wherein the complainant's husband and one other family member is facing trial.

The allegations in the above noted FIR are that an altercation took BAIL APPLN. 1364/2016

place between the complainant and the petitioner on the issue of parking in the street whereafter it is alleged that the petitioner misbehaved with the complainant and when her husband intervened both the complainant and her husband were beaten. No MLC of the complainant's husband was prepared and as regard the MLC of the complainant, the same reveals simple injuries. Considering the facts and circumstances of the case, I deem it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned. The petitioner will join the investigation as and when directed by the Investigating Officer. Petition is disposed of.
