The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.979/2015 registered under Sections 363/366/376 IPC and Section 4 POCSO Act at PS Uttam Nagar. Status report not filed. 2.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 07.09.2015. Upon completion of investigation, a charge-sheet has since been filed. In 164 Cr.P.C. statement, the prosecutrix did not support the prosecution and categorically stated that she had accompanied the petitioner with her free consent.

Physical relations took place between the two with her consent. She was aged around seventeen years.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the Trial Court.
