1. Learned counsel for the Respondent states that the Managing Director of the Respondent is in judicial custody and she has not received any instructions.

2. The mediation has failed.

3. Since the existence of an arbitration agreement between the parties is not in dispute, the disputes can be referred to a sole arbitrator. It is ordered that the arbitration by a Sole Arbitrator shall take place under the aegis of the Delhi International Arbitration Centre ('DAC').

4. The parties will appear before the Delhi International Arbitration Centre ('DAC') on 28th March, 2017 at 11:00 am for further steps in this regard. In the event that the Respondent is not present for any reason, further steps be Arb.P. 411/2016 Page 1/2

taken after due service of notice upon the Respondent.
