% 04.09.2018 Petitioners are the legal heirs of late Chand Ram who is said to have died on 8th August, 1985. A Recommendation dated 29th June, 2012 has been made by first respondent to second respondent on 29th June, 2012 in favour of one legal heir i.e. Sh. Samey Singh. Petitioners' counsel submits that the Recommendation has to be made in the name of all the legal heirs. Impugned Recommendation of 29th June, 2012 (Annexure P-2) takes note of the fact that the share of said Samey Singh is 1595/19140. When the share of said Samey Singh is defined then how can a recommendation for allotment of entire plot in his favour can be made, is not clear from the impugned Recommendation (Annexure P-2).

Upon hearing, it is deemed appropriate to permit petitioners to make a Representation against the Recommendation (Annexure P-2) within a period of three weeks. If such a Representation is received by first respondent, then it be decided within twelve weeks by a speaking order, by giving notice to legal heirs of Late Samey Singh and fate of the Representation be made known to petitioners within two weeks thereafter, so that petitioners may avail of the remedies as available in law, if need be. With the aforesaid directions, this petition is disposed of. DASTI.
