% 16.07.2018 The case against the petitioner involves murder of two persons by fire arm injuries, the victims having been identified as Rishi, aged 15 years and Deepa aged 35 years. As per the prosecution case, the murders took place in the evening hours of 14.01.2018. The petitioner was arrested on 19.01.2018 and there is a direct evidence available as to his complicity in the crimes. Though the charge-sheet has been filed but the question of charge is yet to be considered.

The witnesses to the prosecution include a child aged 10 years who was eye witness to the murder of her mother Deepa. In the facts and circumstances, it will not be appropriate to release the petitioner, not even on interim bail, as is prayed, at this stage of the process, the view taken by the Sessions Court by order dated 05.07.2018 being just BAIL APPLN. 1619/2018

and proper. It may be that the wife of the petitioner is in advanced stage of pregnancy. But then, the physical presence of the petitioner at the time of delivery expected on 19.07.2018 is not really required, there being other members of the family to take care.
