% 09.01.2019 Heard. Perused. In the present case, issued has been framed on 27.07.2011 and the adjournment on the ground of compromise has been taking since 28.02.2018.

Further from the file, it reveals that list of witnesses has been filed on behalf of the defendant in which they are sought to be examined seven witnesses. On the other hand, no list of witnesses has been filed on behalf of the plaintiff.

From the file it also reveals that vide order dated 13.01.2010 the stay order has been passed in favour of the plaintiff as such there i no justification to adjourn the matter and to give another opportunity on account of settlement.

List the matter before the Hon'ble Court for further directions on 04.02.2019.
