O R D E R

The present writ petition filed by the workman assails the award dated 12.09.2007 passed by the Labour Court, Karkardooma Courts in I.D.No.207/06/96 only to the extent that the Court despite holding his termination to be illegal had awarded him a lump sum compensation of only Rs.75,000/-.

During the pendency of the present petition, the parties have arrived at an amicable settlement. The respondent has offered to pay a sum of Rs.4 lakh to the petitioner in full and final settlement of all his claims, which offer is acceptable to the petitioner, who is present in Court.

Accordingly with the consent of the parties, the writ petition is allowed by modifying the impugned award to the extent that the petitioner will be entitled to receive from the respondent a lump sum

compensation of Rs.4 lakhs in lieu of all his claims against the respondents. The agreed amount will be paid to the petitioner within a period of four weeks.

It is made clear that on receipt of the aforesaid amount of Rs.4 lakhs from the respondent, the petitioner will have no surviving claims against the petitioner.

In case, the agreed amount is not paid within the period of four weeks, the same will bear interest @ 12% per annum and the interest will be payable from today.
