% 18.07.2016 Present contempt petition has been filed alleging wilful disobedience of order dated 26th November, 2015 passed in W.P.(C) 9521/2015 whereby the writ petition was disposed of on the following agreed terms:- (i) The examination of the petitioners and those who are similarly placed, will be held, by way of a special examination. This special examination will be conducted between 15.03.2016 to 15.04.2016. (ii) The practical exam for the petitioners and those similarly placed, will also be conducted on or before 31.05.2016. (iii) The result of the special examination will be declared on or before 31.05.2016.
Learned counsel for the petitioner states that though the final result of Practical Exam was published on 8th July, 2016, yet the petitioner's result was withheld with a condition "required to submit
final training completion certificate as per format of Annexure-IV of Information Bulletin". He further states that the petitioner has no further document or certificate to be furnished to the respondents. Keeping in view the aforesaid, the respondents are directed either to declare the petitioner's result or pass an order. Let the decision be taken on or before 19th July, 2016 by 12.00 AM. This Court, however, clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
Since the last date for applying for the next DNB Practical Exam is 19th July, 2016, the petitioner without prejudice to his rights and contentions is permitted to apply for the same. The direction with regard to refund of fees as per order dated 26th November, 2015 shall also be complied with. With the aforesaid directions, the present contempt petition and the application are disposed of.
