% 20.04.2017 CRL.M.A. 6384/2017 (Exemption) Exemption allowed, subject to all just exceptions. Application stands disposed of.

W.P.(CRL) 1131/2017 The petitioner has preferred this petition to seek a writ of habeas corpus for production of Satvinder Kaur, his wife and further prays that she be handed over to the petitioner. As per the Status Report tendered in the Court and which is taken on record, the date of birth of Satvinder Kaur has been found to be 15.08.1999 which makes her about 17 1⁄2 years of age. Satiwinder Kaur has in her statement refused to go back to her parents and being a minor, she cannot be released to the petitioner. Counsel for the petitioner states that Satvinder Kaur is pregnant. He further submits that

Nirmal Chhaya, where his wife has been kept, is not permitting the petitioner to meet her. Nirmal Chhaya is directed to permit the petitioner to meet Satvinder Kaur in case she is also willing to meet him as per their rules and regulations. Nirmal Chhaya is also directed to ensure that proper medication and nutrition is provided to Satvinder Kaur in view of the fact that she is pregnant. Since the whereabouts of Satvinder Kaur are already known and she is in the safe custody of Nimal Chhaya, no further orders are called for.

The petition stands dismissed.
