% 05.04.2018 After some hearing, the counsel for the petitioner submits that he may be permitted to withdraw the present petition and the application filed therewith and instead be given liberty to approach the first appellate court for revival of the proceedings of the appeal (MCA No. 5012/16) which was withdrawn and disposed of accordingly on 20.08.2016. The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed granted. Lest it may be misconstrued, it is clarified that the grant of liberty for moving an application before the first appellate court will not be treated as approval of the grounds on which such revival is intended to be sought. The court concerned will take a decision on such request in the event of it being made, in accordance with law. R.K.GAUBA, J.
